Honest Discourse About Article V Convention Desperately Needed

Whether States should ask Congress to call a convention under Article V of our federal Constitution is one of the most important issues of our time.

By Publius Huldah May 14, 2018

The Delegates to such a convention, as Sovereign Representatives of The People, have the power to throw off the Constitution we have and set up a new Constitution – with a new and easier mode of ratification – which creates a new government.  Americans need the Truth.  But former law professor Rob Natelson’s recent article in The Hill is filled with ad hominems and misstatements.  Natelson is legal advisor for pro-convention groups such as “Convention of States Project” (COSP)........To Read More....

My Take - The Convention that created the Constitution wasn't convened to give the nation a new Constitution, it was convened to the fix the Articles of Confederation.  Once a Convention is convened it's clear there's little to be done to stop them from doing whatever they please, and it's my opinion if an Article V Convention were to be convened what would be produced would be so outrageous it would ultimately lead to violence and a civil war. It seems to me the only option left to prevent such a event would be for the states to reject an Article V Convention.  As time has gone by I've concluded an Article V Convention would destroy this nation.

Here's my Wednesday, February 28, 2018 article dealing with this. Fixing the Deep State Without an Article V Convention

  1. Rich,

From Federalist 45, "The powers delegated by the proposed Constitution to the federal government are few and defined."

It's obvious that todays Federal Gov't hardly fits this description given by James Madison. The 10th amendment also asserts the many undefined powers reside with the states. Article V is the counterbalance mechanism given to the states to keep the federal gov't in check.

As to a revolution...it's already in progress via liberalism as courts change or create laws and liberal ideology permeates the federal gov't with the result of liberties being taken from individuals and the states. From reading your blog I'm confident you could write a comprehensive book on the damages the overbearing federal gov't has inflicted on our country.

Article V requires two thirds of the states to agree to convene a convention to discuss amendments. This convention has no power, according to Article V, to implement proposed amendments. The proposed amendments can be attached to the Constitution by ratification of three fourths of the state legislatures. It's a grueling process as you might surmise. Thus Article V bypasses the federal gov't that is consuming individual liberties. For the revolution you speak of to happen the ratification by the states would have to happen first.

As I see it Article V goes back to the first line of the US Constitution, "We the people of the United States...."

    Kind Regards, Tim

  2. Tim,

Thanks for your continued interest and comments. I've gone back and forth on this and finally concluded an Article V Convention would ultimately be a disaster. But as you say - the states still have to approve the creation of such a convention, and I hope that doesn't happen.

    Best wishes,
    Rich
